Certificate of qualification for self-employment– a document of established form, issued in the procedure established by the authorized body on questions of employment of the foreigner or the stateless person, the relevant requirements of qualification and level of education, self-employment in Kazakhstan according to the occupations in demand in priority sectors of economy (kinds of economic activities

Intra-corporate transfertemporary for a period determined by the labor contract but not exceeding 3 years, renewable for 1 year the transfer of a foreigner or a stateless person employed on the position of leader, Manager, or specialist in the legal entity established in the territory of a member country of the WTO, located and operating outside the territory of Kazakhstan, branches, subsidiaries, representative offices of this legal entity established on the territory of Kazakhstan in accordance with legislation of the RK

Permit to attract foreign labor– a document issued by the local Executive body of the employer to attract foreign labor in the Republic of Kazakhstan

List of documents

A foreigner or a person without citizenship residing outside the Republic of Kazakhstan submits an application to foreign institutions of the RK certificate in the same language, with translation on state or Russian language.

If a foreigner or a stateless person is located in the Republic of Kazakhstan to obtain a certificate, the foreigner or a stateless person or a person authorized by him / her sends a paper application for issuing a certificate to the authorized body. The following documents are attached to the application::

1.       a copy of the identity document;

2.       notarized translations of educational documents;

3.       a copy of the document confirming employment.

1.       Notarized translation of the employment contract;

2.       Information about meeting special conditions.

3.       Documents of foreign workers to be attracted, confirming their qualification:

1.       notarized copies or translations of educational documents;

2.       information about the employee's employment;

3.       Information on local content in personnel when attracting foreign employees within the framework of internal transfer;

4.       A copy of the foreign employee's identity document;

5.       Form for agreement with employer on special conditions for issuance of permits in accordance with;

6.       Information about attracted foreign employees.

5.       A copy of the foreign employee's identity document;

The period of consideration

The authorized body within 3 working days from the date of registration of documents sends them to the Commission for consideration. Based on the Commission's recommendation, the authorized body makes a decision to issue A certificate in the form within 15 working days from the date of acceptance of the application.

The local Executive body accepts the employer's application for a permit to attract foreign labor not earlier than 15 calendar days and not more than 60 calendar days from the date of submission of information on the availability of vacant jobs (vacant positions).

The decision to issue or refuse to issue a permit is made by the local Executive body within 7 working days from the date of acceptance of the employer's documents.

The validity of

The certificate is issued for a period of no more than 3 months.In the case of a submission by the foreigner or a person without citizenship the following documents:

1.       a certificate previously issued by the authorized body;

2.       an application in any form, indicating information about the employer, including the name, business identification number or individual identification number of the employer;

3.       a copy of the employment contract.

The authorized body issues the following documents:Reference for the term of validity of the employment contract, but not more than 3 years.

Permits to attract foreign labor within the framework of internal corporate transfer are issued for the transfer period specified in the employment contract, but not more than 3 years with the right to extend it no more than once for twelve months.

In the absence of an employment contract, the term of intra-corporate transfer is determined by a letter or agreement (contract) on intra-corporate transfer, but not more than 3 years with the right to extend it no more than once for 12 months.

Permits for attracting foreign labor are issued for the following period::

1.       for the first category – 12 months extension annually for a period of twelve months;

2.       for the second and third categories by 12 months, with renewal for a period of twelve months, but not more than three times;

3.       for the fourth category for 12 months without extension;

4.       for seasonal foreign workers – up to 12 months, without extension.
